TWO PHONE CALLS WITH CRUCIAL INFORMATION AND VALUABLE PERSPECTIVES

P. Geoffrey Feiss was Dean of the Faculty of Arts & Sciences at William & Mary from 1996-2003. He was Provost from 2003-2009. He was my most prominent advisor and supporter from the beginning of the crisis through my move to Texas in May 2019. Though he had been retired for a decade and was far removed from the action at his home in Maine, he was responsible for breaking the case wide open with the letter to active faculty (written with Terry Meyers and Kate Slevin) on Sept 8, 2016.

I had lost my pay and all benefits of employment (but not my job) four weeks before--and had it not been for Feiss, Slevin, and Meyers, no one on campus would have known anything about it.

Shannon Beebe was my employment lawyer (see "Missing in Action," below).

Question: Why was Nate Green (or his office) so worried that he/they were holding up the settlement? To conclude the case, a motion had to be filed with the Eastern District Court of Virginia. "Dismiss with prejudice." Meaning: end of story. Of course the CAO was at risk, but here is what I ask Shannon--this is the central question:
​"If it's a risk management issue, why did they want me to sign a revised agreement with more than 'W&M et. al.'?
​Could that not be handled in the motion to dismiss?"
I did not understand the answer at the time. It explains a great deal about what was happening then, as well as the Commonwealth's Attorney's relentless pursuit of me since. ​

I have included a transcript of her call to me on April 12, 2018.


MISSING IN ACTION

I have been telling people that Shannon, my superb employment lawyer in Arlington, VA, was 27 years old. Turns out she is 34 years old.

I thought she had only three years of experience litigating cases like mine when she took it. Turns out she had only TWO years experience. 

She looks like she's 27. That's what I meant. And I was worried about her. Listen to the phone call. She was worried about me when we had this phone call.

I had no money. No job. No prospect for getting a job, owing to the defamation of the false arrests. I had no friends.

And I was equally worried about her. She had learned of the worst abuses of a university professor, by far, on record. On the day we spoke, April 12, 2008, the university was, for reasons we could not understand, stalling in signing the settlement. When they finally signed--six days after this call--the wheels were in motion for me to receive $50,000, which arrived by the end of the month. That was a half-year's salary, a huge amount. It meant I would survive.

Shannon was one of the only friendly voices in my life at the time. She taught me a lot about the law, and a lot about how to behave to gain legal advantage, and I will never be able to repay her for her kindness. Her dedication not just to my well-being, but to that of the students at William & Mary, was remarkable. The demand letter she wrote on December 1, 2017, revealed that students were being abused in exactly the same way I had been. This argument was confirmed in the Flat Hat article, "Discovering David Dessler."

To protect Shannon, I had to let her get scared away. She's back in Vancouver, where she grew up. She left Virginia in Sept 2018. I cannot confirm that she is okay.
